This Privacy Policy (“Policy”) describes the methods and purposes of processing personal data carried out by Ferrari Chiavari s.a.s. di Ferrari Paolo & C., with registered office at Via della Libertà 32, Rapallo (Genova), in its capacity as Data Controller (hereinafter, the “Agenzia Ferrari” or the “Controller”) of the website www.ferrarihotelsre.com (the “Site”) and its related services (the “Services”).
Agenzia Ferrari respects the privacy of each user who visits the Site and uses the Services (“User”). This Policy does not apply to third-party websites accessible through hyperlinks on the Ferrari Hotels Site.
The processing of Users’ personal data will be carried out in accordance with the applicable law, with particular reference to Italian Legislative Decree 30 June 2003, no. 196 (the “Privacy Code”), as amended by Regulation (EU) 2016/679 of 27 April 2016, effective from 25 May 2018 (hereinafter, jointly, the “Applicable Privacy Law”).
This Policy applies only to the websites mentioned above and not to other websites that may be accessed by the User through specific links. Users/visitors are invited to carefully read this Privacy Policy before submitting any type of personal information and/or filling out any electronic form present on the Site.
This Policy, as well as the use and management of Cookies, may be subject to changes or updates at any time. In such case, Agenzia Ferrari s.a.s. will publish a notice on the homepage of the Site. In any event, Agenzia Ferrari s.a.s. invites you to check the Privacy Policy periodically to stay informed about any changes.
The Data Protection Officer is Mr. Paolo Ferrari.
The IT systems and software procedures used to operate this Site acquire, during their normal functioning, certain personal data, the transmission of which is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified individuals, but, by its very nature, could, through processing and association with data held by third parties, allow Users to be identified. This category of data includes:
identification and contact details (e.g. name, surname, email, telephone number, etc.);
data relating to the content of electronic communications exchanged with Agenzia Ferrari for the purposes referred to in section 2 a);
data relating to the IP address or device ID of a User through which the Site or Services are accessed;
data relating to the type of browser used by Users, as well as the date and time of access to the Site or Services.
The above data are used solely for the purpose of obtaining anonymous statistical information on the use of the Site and to check its correct functioning, in addition to the following purposes:
a) responding to User requests sent through the Site;
b) improving the presentation, features, and functionality of the Site and Services, as well as administrative activities and management of User requests;
c) enabling Users to participate in surveys and polls anonymously;
d) providing support for the Services offered, upon Users’ request;
e) preventing fraud or crimes committed through the Site or Services;
f) fulfilling legal or tax obligations under applicable law;
g) with consent, contacting Users via automated (email, SMS, MMS, social media, operatorless calls) and non-automated means (postal mail and operator-assisted telephone calls) to propose commercial offers and promotions, as well as involving them in research and market surveys, including the sending of newsletters;
h) with consent, analyzing Users’ commercial choices and preferences in the use of the Site or Services, in order to personalize the offer of products and services dedicated to them.
For the purposes under a) to f), Agenzia Ferrari will process Users’ personal data on the basis of their requests and its legitimate interest. For the purposes under g) and h), Agenzia Ferrari will process Users’ personal data on the basis of their consent.
Data processed on the basis of consent will be retained for the time strictly necessary to achieve the purposes for which they were originally collected and, in any case, will no longer be processed once consent has been withdrawn. If processing is instead carried out in order to comply with legal, tax or judicial obligations, or for the determination of liability in case of hypothetical IT crimes against the Site, data may be retained for up to ten (10) years.

When Users/visitors, by connecting to this Site, send their personal data to access certain services or submit requests via chat and/or email, this involves the acquisition by Agenzia Ferrari s.a.s. of the sender’s address and/or other personal data, which will be processed solely to respond to the request or to provide the requested service.
Personal data provided by Users/visitors will only be communicated to third parties if the communication is necessary to fulfil the Users’ requests.
The data provided through this form include name, surname, email address and phone number and will be used exclusively to respond to your requests or questions. Providing such data is mandatory in order to submit a query to Agenzia Ferrari. Any refusal will prevent you from receiving a response.
Personal data are processed with automated tools for the time strictly necessary to achieve the purposes for which they were collected. Specific security measures are observed to prevent data loss, unlawful or incorrect use, and unauthorized access.
All personal data will mainly be processed through electronic tools and methods; however, paper-based processing by Agenzia Ferrari is not excluded. The Controller will take all necessary security measures to minimize the risk of destruction or loss of the data, including accidental, unauthorized access, or processing not permitted or not compliant with the purposes indicated in this document.
Nevertheless, since it is not possible to guarantee that the measures adopted for Site security and data transmission can exclude any risk of unauthorized access or data dispersion, we invite Users to ensure that their computers are equipped with up-to-date antivirus software for network protection of both incoming and outgoing data, and that their Internet provider has adopted firewalls, anti-spam filters, or other appropriate measures for the security of data transmission.
Except as specified for browsing data, Users/visitors are free to provide their personal data. Failure to provide them may only result in the impossibility of obtaining what has been requested.
When providing our Services, we may use third-party software and/or services to collect information passively, without your knowledge, while you are browsing or interacting with the content of our Site, as well as information about the device you are using. The sole purpose of passively collecting this information is to better understand how you use and interact with the Web, with the aim of improving your user experience and identifying possible errors during the creation of our Site.
The information collected includes, but is not limited to:
IP address of your device
Screen size of the device used
Device ID and browser information
Geographic location (country)
Selected display language
Pages visited
Date and time of page visits
For this purpose, we use third-party web analytics services, which passively collect information to examine the use of the Site and, in general, to collect information about Site activity. Agenzia Ferrari may also use third-party services such as Google Analytics, which collects information about your browsing via cookies or other mechanisms.
In no case does Agenzia Ferrari collect or store identifying data (including, in particular, banking or payment data).
Users’ personal data will not be transferred to countries outside the European Union that do not ensure levels of data protection in line with Applicable Privacy Law.
The use of the Site and Services is reserved only for adult Users. Agenzia Ferrari does not process personal data of minors under the age of eighteen (18) without parental consent.
Processing connected to the web services of the above-mentioned sites takes place at the registered office of Agenzia Ferrari in Rapallo (Genova) and/or at the office of the hosting and/or website management company, and is handled only by technical staff authorized to process, or by others charged with occasional maintenance operations.
No data deriving from the web service is communicated or disseminated. Personal data provided by Users who submit requests for information materials are used solely to perform the service or provision requested and are communicated to third parties only if necessary for this purpose.

Pursuant to Applicable Privacy Law, Users have the right to:
be informed about the purposes and methods of processing their personal data;
access their personal data;
obtain a copy of their personal data, where stored in countries outside the EU, and to obtain information on where such data is stored or transferred;
request the rectification, updating or integration of their personal data;

The Site www.ferrarihotelsre.com uses cookies.

Agenzia Ferrari uses:
Technical cookies: to provide better service to Users (including navigation and functionality cookies, login and preference storage).
Analytical cookies: with the help of Google Analytics (including DoubleClick), Zoopim, Yandex Metrica, to detect visitor numbers, visited pages, time spent on the Site, and other statistical data.
Profiling cookies: to create “user profiles” and send promotional messages in line with preferences and choices expressed during browsing (remarketing with Google and/or Facebook).

The exercise of your rights as a Data Subject is free of charge under Article 12 GDPR. However, in cases of manifestly unfounded or excessive requests, the Controller may charge a reasonable fee or refuse the request.
